In the ongoing pandemic, death statistics influence people’s feelings and government policy. But when does COVID-19 qualify as the cause of death? As philosophers of medicine interested in conceptual clarification, we address the question by analyzing the World Health Organization’s rules for the certification of death. We show that for COVID-19, WHO rules take into account both facts and values.

Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

Philosophers of medicine have formulated different accounts of the concept of disease. Which concept of disease one assumes has implications for what conditions count as diseases and, by extension, who may be regarded as having a disease and for who may be accorded the social privileges and personal responsibilities associated with being sick. In this article, we consider an ideal diagnostic test for coronavirus disease 2019 infection with respect to four groups of people—positive and asymptomatic; positive and symptomatic; negative; and (...) untested—and show how different concepts of disease impact on the disease and sickness judgements for these groups. The suggestion is that sickness judgements and social measures akin to those experienced during the current COVID-19 outbreak presuppose a concept of disease containing social harm as a component. We indicate the problems that arise when adopting this kind of disease concept beyond a state of emergency. (shrink)

Over the last three quarters of a century, international guidelines and regulations have undergone significant changes in how children are problematised as participants in biomedical research. While early guidelines enacted children as vulnerable subjects with diminished autonomy and in need of special protection, beginning in the early 2000s, international regulatory frameworks defined the paediatric population as vulnerable due to unaddressed public health needs. More recently, ethical recommendations have promoted the active engagement of minors as research partners. In this paper, I (...) adopt a post-structuralist approach to policy analysis to examine deep-seated assumptions and presuppositions underlying the changes in the problematisation of children as biomedical research participants over time. While biomedical research ethics focuses on the autonomy and vulnerability of minors, ethical guidelines are situated in specific sociocultural contexts, shaped, among other things, by contingent public health needs and changing conceptions of the value of research and science for society. In the process, I demonstrate the challenge of moving away from an approach that in taking adults as the model overshadows the complexity of children’s lived experiences as well as their personal, cultural, and social lives. The lack of acknowledgement of this complexity makes children vulnerable to epistemic injustice, which is particularly crucial to address in public involvement initiatives. (shrink)

Most of the epidemiological models of the Covid-19 pandemic contain the reproduction number as a parameter. In this article we focus on some shortcomings regarding its role in driving health policies and political decisions. First, we summarize what R is and what it is used for. Second, we introduce a three-question matrix for the evaluation of any construct or parameter within a model. We then review the main literature about R to highlight some of its shortcomings and apply to them (...) our three-question matrix. This study explores the intra-organizational antecedents of sustainable governance by examining the impact of female presence at the corporate apex. Drawing upon the upper echelon theory, we investigate whether women in top positions influence sustainable governance practices. Our research focuses on a sample of companies operating within two distinct market economies: liberal market economies (LMEs) and coordinated market economies (CMEs). The United States, represented by the S&P100, and the United Kingdom, represented by the FTSE100, serve as examples of LMEs. Conversely, (...) Germany (DAX30), France (CAC40), Spain (IBEX35), and Switzerland (SMI) are illustrative of CMEs. Analyzing archival data spanning from 2010 to 2019, we confirm that the presence of a critical mass of women on the board of directors significantly increases the likelihood of establishing a sustainability committee within organizations. This relationship holds true across both LMEs and CMEs, highlighting the universal importance of gender diversity in driving sustainable governance initiatives. Interestingly, we observe that the impact of women with structural power on sustainability committee formation is specific to LMEs, suggesting the context-dependent nature of female leadership in sustainable governance. This volume offers a meta-philosophical reflection on feminist philosophies of science. It emphasizes and discusses both the connections and differences between "traditional" philosophies of science and feminist philosophies of science. The collection systematically analyses feminist contributions to the various philosophies of specific sciences. Each chapter is devoted to a specific area of philosophy of science: general philosophy of science, philosophy of biology, philosophy of climate sciences, philosophy of cognitive sciences and neurosciences, philosophy of economics, philosophy of history and archaeology, philosophy (...) of logic and mathematics, philosophy of medicine, philosophy of psychology, philosophy of physics, and philosophy of social sciences. Since some of these areas have so far rarely been addressed by feminist philosophers, this new collection provides new angels and stimulates the debate on pivotal issues that are part and parcel of both "traditional" philosophies of science and feminist philosophies of science. Human experience has a symbolic structure. By focusing on the symbolism of human action, this essay considers the reciprocal influences and the essential differences between Paul Ricœur’s hermeneutics and Clifford Geertz’s cultural anthropology. Through reference to Ricœur’s Lectures on Ideology and Utopia, the section on “Ideology, Utopia, and Politics” in From Text to Action, and Geertz’s 1973 book The Interpretation of Cultures, this paper aims at reconstructing the dialogue between these thinkers. I begin with a broad framing of the encounter (...) between Ricœur and Geertz, and then turn to the notion of the symbolic mediation of action, considering it as the shared key concept between these authors. These reflections will lead to an examination of the semiotic conception of culture, opening up the discussion of a nonpejorative dimension of ideology. (shrink)

Savant aux intérêts multiples--historiques, scientifiques et religieux, connu et estimé dans l'Europe du XVIIIe siècle, bien qu'ayant très peu publié de son vivant, Firmin Abauzit reste à beaucoup d'égards un mystère. Comment ce réfugié huguenot, arrivé à Genève encore enfant après la révocation de l'édit de Nantes, a-t-il pu bénéficier d'une réputation flatteuse dans la ville d'accueil alors que ses opinions hétérodoxes sur la trinité ou la christologie ou les prophéties bibliques étaient notoires? Au-delà des étiquettes faciles, quelle était la (...) nature exacte de son hétérodoxie? Comment sa légendaire 'modestie', qui lui a fait refuser honneurs et charges publiques, se concilie-t-elle avec le fait de laisser copier et circuler abondamment en Europe ses manuscrits? This paper aims to perform a qualitative synthesis of literature concerning the representation of information in displaced archives. Methodologically, this communication is configured in a metasynthesis oriented to theory building, constituting a non-reactive, documentary-based and exploratory type of study, focused on articles and books chapters published in English between 1954 and 2019. The collection of texts is supported by the SPICE strategy, applied to the search in databases (WoS and EBSCO). We adopted content analysis according to the assumptions of Charmaz (...) and Finfgeld-Connett. Of the 443 records, 155 texts that responded to the research purposes were included. Three themes emerged from the content analysis around the aforementioned theme with a view to theory building: “anarchivism as (non-) representation”, “archive of the archive”, and “archival canon”. Finally, displaced archives constitute an emerging theme in several domains, so it is important to explore the complex nature of this phenomenon from the point of view of representation and knowledge organization. This article seeks to show Pope Francis’ position, right from the beginning of his pontificate, and what he expects from the Roman Catholic Church in relation to LGBT people. In order to do that, some documents of his pontificate are analyzed in relation to this theme. Among them: Community of Community: A new Parish, Preparatory for the III Assembly, III Extraordinary General Assembly of the Synod of Bishops, XIV Ordinary General Assembly, Encyclical Letter Laudato Si, Post-Synodal Exhortation Amoris Latitia etc. (...) Then, we try to understand the meaning of Francisco's gestures, and to understand which church he wants. What changes and perspectives may occur between the Church and LGBT people, based on the Second Vatican Council, which the pope attempts to bring back, and the unconditional love of God found in the gospels. It is important to remember that in Francis' pontificate, dialoguing, welcoming, integrating, and finding points to come together in favor of life, especially the lives of the most vulnerable, is always very important. Si delineano dapprima alcune linee della storia della rivista e le sue ispirazioni teoriche e storiografiche principali, per poi mettere in luce le ragioni della rilevanza del tema dell’analogia, come oggetto utilizzato e pensato nei secoli medievali e come strumento di ricerca storiografica, e infine si conclude con l’articolazione del fascicolo. The introduction to the issue Analogy (...) and the Middle Ages sive twenty years of analogies presents issue n. 18 of Doctor Virtualis and traces the milestones of the journal. It first sketches some lines of the history of the journal and its main theoretical and historiographical inspirations, then highlights the reasons for the relevance of the theme of analogy, as an object used and thought of in the medieval centuries and as a tool for historiographical research, and finally concludes with the articulation of the issue. Una de las cuestiones metafilosóficas que ha suscitado especial dedicación y ha atraído la atención de filósofos de distintas filiaciones es la cuestión acerca del canon filosófico. ¿En qué consiste? ¿Cómo debe ser concebido? ¿Cómo se constituye? ¿Cómo funciona? ¿Dónde está? ¿Qué relación guarda con la historia de la filosofía y con la historia de las (...) ideas en general? ¿Cuáles son sus vínculos con la institucionalización y profesionalización de la filosofía y con la comunidad filosófica? son algunas de las preguntas planteadas.En nuestro medio y en general en la comunidad filosófica hispano parlante, la aparición de la obra póstuma de Eduardo Rabossi En el comienzo Dios creó el canon. Biblia berolinensis en la que su autor aborda con originalidad y agudeza esta temática, ha resultado ser un estimulante disparador para el examen y discusión de la cuestión que nos ocupa. Rabossi declaró que se daba por satisfecho si lograba incentivar la polémica. Creemos que lo ha logrado ampliamente. Este número de Análisis Filosófico es una prueba de ello; en él recogemos parte de la reflexión que ha provocado el desafío lanzado por Rabossi. (shrink)

O objetivo do presente texto é apresentar algumas das críticas que Origens do Totalitarismo de Hannah Arendt recebeu e as discussões que suscitaram, demonstrando as dificuldades de compreender o sistema totalitário e a novidade que a interpretação de Arendt gerou. Entre os principais críticos estão Raymond Aron, Waldemar Gurian, Kurt Blumenfeld, Eric Voegelin e Karl Jaspers. Serão apresentadas algumas das críticas para, em seguida, estabelecer a discussão a partir da argumentação contida nos textos de Arendt. Serão utilizadas como principais referências (...) as obras de Arendt Origens do Totalitarismo e A condição humana, os textos “Compreensão e política”, “Sobre a natureza do totalitarismo: uma tentativa de compreensão”, “A tradição e a época moderna”, “O conceito de história: antigo e moderno”, “Que é autoridade” e “Uma réplica a Eric Voegelin”. Também serão utilizadas as cartas de Arendt com Karl Jaspers e Kurt Blumenfeld e alguns dos textos dos críticos. As biografias sobre Arendt de Elizabeth Young-Bruehl, Sylvie Courtine-Dénamy e Laure Adler e textos de Odílio Alves Aguiar e Daiane Eccel serão utilizadas como fontes importantes. Concluiu-se que Arendt desafiava a compreensão ao não simplesmente descrever os acontecimentos, mas ao realizar aquilo que acreditava ser a própria filosofia, um exercício de pensamento. (shrink)

The general definition of mental disorder stated in the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders seems to identify a mental disorder with a harmful dysfunction. However, the presence of distress or disability, which may be bracketed as the presence of harm, is taken to be merely usual, and thus not a necessary requirement: a mental disorder can be diagnosed as such even if there is no harm at all. In this paper, we focus on the (...) harm requirement. First, we clarify what it means to say that the harm requirement is not necessary for defining the general concept of mental disorder. In this respect, we briefly examine the two components of harm, distress and disability, and then trace a distinction between mental disorder tokens and mental disorder types. Second, we argue that the decision not to regard the harm requirement as a necessary criterion for mental disorder is tenable for a number of practical and theoretical reasons, some pertaining to conceptual issues surrounding the two components of harm and others pertaining to the problem of false negatives and the status of psychiatry vis-à-vis somatic medicine. However, we believe that the harm requirement can be maintained among the specific diagnostic criteria of certain individual mental disorders. More precisely, we argue that insofar as the harm requirement is needed among the specific diagnostic criteria of certain individual mental disorders, it should be unpacked and clarified. (shrink)

Qual é o objeto da lógica? Seria a arte de bem conduzir o discurso? Mas conduzí-lo para onde, com que finalidade? Haveria uma normatividade independente, que definisse o racional independente do real? É Lacan que pergunta e nos responde no sem. XIX: “eu proponho definir o objeto da lógica como aquilo que produz a necessidade de um discurso. E afirmo que o simbólico, o imaginário e o real se afirmam nos impasses da lógica. ” (LACAN, 2011, p. 40). Muitos comentadores (...) encaram os recursos lógicos de Lacan como uma provocação, mas entendo que não, pois são muito coerentes com seus princípios, tanto lógicos, quanto linguísticos, antropológicos e principalmente matemáticos. Introduction to special issue "Ricoeur and the Problem of Space".

Background: The intensive care unit environment focuses on interventions and support therapies that prolong life. The exercise by nurses of their autonomy impacts on perception of the role they assume in the multidisciplinary team and on their function in the intensive care unit context. There is much international research relating to nurses’ involvement in end-of-life situations; however, there is a paucity of research in this area in Brazil. In the Brazilian medical scenario, life support limitation generated a certain reluctance of (...) a legal nature, which has now become unjustifiable with the publication of a resolution by the Federal Medical Council. In Brazil, the lack of medical commitments to end-of-life care is evident. Objective: To understand the process by which nurses exercise autonomy in making end-of-life decisions in intensive care units. Research design: Symbolic Interactionism and Corbin and Strauss theory methodology were used for this study. Participants and research context: Data were collected through single audio-recorded qualitative interviews with 14 critical care nurses. The comparative analysis of the data has permitted the understanding of the meaning of nurse’s experience in exercising autonomy relating to end-of-life decision-making. Ethical considerations: Institutional ethics approval was obtained for data collection. Participants gave informed consent. All data were anonymized. Findings: The results revealed that nurses experience the need to exercise autonomy in intensive care units on a daily basis. Their experience expressed by the process of increase opportunities to exercise autonomy is conditioned by the pressure of the intensive care unit environment, in which nurses can grow, feel empowered, and exercise their autonomy or else can continuously depend on the decisions made by other professionals. Conclusion: Nurses exercise their autonomy through care. They work to create new spaces at the same time that they acquire new knowledge and make decisions. Because of the complexity of the end-of-life situation, nurses must adopt a proactive attitude that inserts them into the decision-making process. (shrink)

Este artículo explora mi devenir como indagadora narrativa en la educación superior. Se trata de una aproximación íntima a las formas teóricas y metodológicas en las cuales, dentro de mi grupo de investigación en la Facultad de Humanidades de la Universidad Nacional de Mar del Plata, Argentina, hemos recogido relatos sus docentes y estudiantes para estudiar entre otros temas, representaciones sobre el currículo, buenas prácticas de enseñanza, docentes memorables, identidades y experiencias de docentes en ciernes. En el transcurso de este (...) devenir indagador reconocemos, en este orden, estaciones de cruces con diversas metodologías tan narrativas como íntimas: investigación de narrativas; investigación con narrativas; investigación biográfico-narrativa; indagación narrativa; indagación poética; autoetnografía; indagación narrativa visual. Examinamos los vínculos metodológicos y teóricos entre qué investigamos y relatamos, cómo lo hacemos y lo re-presentamos y quiénes devenimos entre los contenidos teóricos y las formas metodológicas. Mediante este trabajo, aspiramos a continuar los diálogos con el variado universo narrativo en el ámbito de la educación universitaria. (shrink)

Introduction française au numéro spécial "Ricœur et la question de l'espace".

Paul Ricœur and Jan Patočka are considered among the most important phenomenologists of the 20 th century. As with Ricœur, Patočka ’s philosophy is shaped by an enduring critical confrontation with Husserl’s phenomenology and Heidegger’s phenomenological analyses of Dasein. The present paper aims at analyzing Ricœur ’s and Patočka ’s convergences and mutual inspirations in their perspectives on the topic of history. More precisely, I will take up the question of the meaning of history in Ricœur and Patočka as profoundly (...) influenced by their readings of Husserl’s Krisis. Then, the attention will be turned to Ricœur ’s concept of historicity and Patočka ’s notion of care of the soul as concerns involved in the search for meaning in history as an open-ended mediation. In this context, I will discuss Ricœur ’s and Patočka ’s critical examination of Heidegger’s conception of thrownness and projection, that is, Dasein’s already-being-in-the-world and its disclosedness, as necessary concepts for understanding their own philosophical approaches to history. BackgroundThis study analyzed the difference in psychological distress of the healthcare workers in three different periods of the coronavirus disease 2019 (COVID-19) pandemic in Argentina. Specifically, from the third week of the mandatory quarantine through the two following weeks.MethodsAnalysis of the responses of 1,458 members of the health personnel was done on a questionnaire on healthcare workers concerns regarding the care of patients with coronavirus, indicators of depression, anxiety, intolerance of uncertainty, and coping.ResultsThe psychological indicators that were considered presented differences (...) between the evaluated periods. Perceived concerns about the possibility of infecting loved ones and infecting themselves were greatest in the periods after the onset of the pandemic. In addition, the perception of how the work environment worsened and how lack of sleep interfered with their work was also higher in periods 2 and 3. The same results were found in the indicators of depression, anxiety, and intolerance of uncertainty. Finally, the indicators of high tension and concurrent lack of emotional control, which was greater in the last periods evaluated, were also expressed in the coping strategies (showing emotional lability, only contained by hypercontrol).ConclusionThe differences found in the psychological indicators between the evaluated periods support the need for early psychological care of health personnel which should be a priority of public health and a fundamental fact to increase its immediate effectiveness in the care of infected patients.
